OF A COMMITTEE OF THE STATE DUMA OF THE TOMSK OBLAST

1. The Common regulations


1. A committee is the permanent body of the State Duma of the Tomsk Oblast (further - Duma) and accountable to Duma. The committee is formed for a legitimate period of Duma's functioning.

2. The committee's main activity is the preparation of the resolution projects of the Duma, which are concern the committee's responsibility and determined 'by the order of the chairman of the Duma.

3. In its activity the committee is guided by the Constitution of Russian Federation, the federal legislation, orders of the President of Russian Federation, regulations of the Government of Russian Federation, the Charter (the basic law) of Tomsk Oblast, other standard acts of Tomsk oblast and by this Statute.

4. The committee is conducting its activity independently as well as acting with the other committees of the Duma, bodies of the Administration of Tomsk Oblast, bodies of local governments.

2.The Structure of the Committee and the order of its forming


1. The committee consists of the deputies of Duma. The list of the committee is approved by Duma according to the order of Duma.

2. A deputy is excluded from the committee on the basis of his written statement. The changes in the structure of the committee are approved by the order of Duma.

3. The committee is headed by the chairmen, who is elected of a list of deputies of Duma by the majority of votes.

3. The authorities of the Committee


1. In the frame of its authorities, the committee implements the following:

- working out the projects of laws and other standard acts of Tomsk oblast;

- considering, according to Duma regulations, projects of laws and other legislative acts, which are coming to the committee;

- preparing decisions on the projects of laws and other standard acts, which have been already considered by the committee;

- preparing projects of resolution of Duma;

- preparing on the instructions of Duma projects of standard acts and corresponding materials, which are sent by Duma as an act of initiation of laws to the State Duma of the Federal Gathering of Russian Federation;

- conducting of the interaction in frame of its competence with other committees and commissions of legislative power in other oblasts of Russian Federation, The Council of Federation and the State Duma of the Federal Gathering of Russian Federation;

- making a decision of parliamentary hearings in Duma;

- considering coming appeals from citizens and organizations;

- exercising control over implementation of Duma regulations concerning committee's subject of activity.

2. The permanent commissions of the committee can be organized as a part of the committee's structure for the implementation of activity on the permanent directions of its work.

3. For the preparation of any issues of its competence the committee may create working groups. These groups might be formed of a list of the deputies of the committee, other deputies of Duma, representatives of state authorities and any other organizations.

4. The committee, in the frame of its activity, has a right to request local governments and other organizations about documents and materials, which are necessary for its activity.

5. The committee has a right to appeal to the Council of the Duma to return projects of standard acts in case of their necessity to be elaborated significantly (including the reason of doubling of federal standard acts).

4. The Order of the Committee's Work


1. The meeting of the committee is law competent if more then a half of the committee's members are present at the meeting.

2. The meeting of the committee is hold according to the schedule, approved by the committee, but not rarely then one time a month.

3.Special meeting of the committee is convened by the chairman of Duma or the chairman of the committee on their will or on the will of not less then three members of the committee.

4. The chairman of the committee must inform the committee members and other participants of a meeting about the coming meeting not less then for two days.

5. Decisions of the committee are approved by the simple majority of present members of the committee.

If it is necessary decisions of the committee can be approved by the result of an interrogation of the committee members (without any meeting). In this case, the opinion of a deputy is confirmed by his signature in the signature list.

1. The chairman of Duma, vice-chairmen of Duma, chairmen of other committees have a right to participate in a meeting of the committee. They also have a casting vote in such meetings.

Deputies of Duma, who are not the members of the committee, the chairman of the Controlling Chamber of Duma, vice-chairman of the Controlling Chamber of Duma, deputies and members of the Federal Gathering of Russian Federation, representatives of Oblast administration, members of Duma's machinery, invited specialists can participate in a meeting of the committee with a right of deliberative vote.

2. Decisions of the committee and a protocol of a meeting are signed by the chairman of the committee.

3. In case of an absence of the chairman of the committee, the vice-chairmen or presiding person, who is elected by the committee, have a right to sign a decision and a protocol of a meeting

4. According to the regulations of Duma, the committee should prepare a project of law, order, other standard act on a question, which is stand before the committee.

5. A corresponding department of Duma's machinery is responsible for organization and methodical supporting of the committee's work.

5. The responsibility of the Chairmen of the Committee.


1. The chairmen of the committee works in the committee on the permanent professional base. The chairmen of the committee is a member of the Council of Duma.

2. The chairmen of the committee is under the control of Duma. The chairman is responsible for an activity of the committee and organization of committee's work.

3. The chairman sings decisions of the committee.

4. The chairman organizes work of the committee in following way:

- convokes the hearings of the committee;

- forms a project of a committee's hearings agenda;

- prepare questions for discussion during hearings;

- presides on hearings of the committee;

- provides members of the committee with the necessary documents, projects of standard acts;

- invites representatives of state and non-state organizations, scientists and experts for participation in committee's hearings;

- controls implementation of the committee's orders by its members.

5. The chairman of the committee makes a report about results of committee's activity before the Council of Duma and before the whole Duma not less then one time an year.

6. Duma can make a decision about pre-term abdication of the committee chairman power according to chairman's report or initiative of Duma's deputies. This decision is approved by simple majority. In this case The chairman of Duma has a right to put to the vote a question of election of new chairman of the committee.

7. The chairman of the committee can be relieved of his post on the basis of his written statement.

6. The responsibility of a member of the Committee.


1. A member of the committee must present on hearings and participate in this work. If a member can not participate in hearings, he must inform a chairman of the committee not less then two days before

2. A member of the committee has a right to make proposals and remarks to an agenda of hearings, way of discussion and essence of debating questions.

3. A member of the committee has a right to participate in discussion on committee's hearings, make proposals and remarks, ask reporters and chairmen of hearings, make presentations of his proposals, make inquiry.

4. A member of the committee, whose proposals have not got any support of the committee, can appeal with his special opinion to a gathering of the whole Duma.

7. Permanent Commissions of the Committee.


1. Permanent commissions of the committee are formed by a decision of Duma on a basis of a committee's proposal on a term of the present Duma functioning.

2. A commission can be consists of deputies of Duma, specialists of Tomsk Oblast Administration, experts and other persons, who are competent in an activity of the commission.

A composition of the commission is approved by the majority of votes on the gathering of the whole Duma acording to a proposal of the chairman of Duma.

3. A chairman of the commission is elected of a list of all of the members of the commission. The chairman of the commission is appointed and relieved of his post the same way as a chairman of the committee.

The election of the chairman of the commission is formalized by the resolution of Duma. The chairman of the commission in his possition is a vice-chairman of the committee.

4. Комиссия по поручению председателя комитета осуществляет:

- preliminary analisis of questions and preparing of committee decision projects;

- eleboration of law projects and other standard acts of the Oblast;

- consideration of addresses of citizens and organizations.
